In Germany, there are two new decisions on the liability of registrars and of CloudFlare for copyright infringements committed by their customers. The Federal Court of Justice (BGH) in “Störerhaftung des Registrars” (GRUR 2021, 63) and the Regional Appellate Court of Cologne (OLG Köln) “CloudFlare” (GRUR 2021, 70), drove developments worth reading and discussing. Prof. Dr. Jan Bernd Nordemann, partner at NORDEMANN, discusses those decisions in detail in the first issue of the German IP journal GRUR 2021 (GRUR 2021, 18).
